NIK BAKER’S CLUB REWARDS PROGRAMME TERMS & CONDITIONS

We, M.G. Bakers Pvt. Ltd. (hereinafter referred to as the “Company”) (having registered Brand Name “NIK BAKER’S”) delighted to welcome all to our Nik Baker’s Club Rewards Programme! These terms and conditions ("Terms & Conditions") govern your participation in the Nik Baker’s Club Rewards Programme ("Programme"). By participating in the Programme, you agree to the following Terms and conditions.

1. Definitions

In this Programme’s terms & conditions, the following definitions are used:

1.1. “Registration Form”- The programme registration form link will be shared by the Cashier upon completion of Customer’s purchase at Nik Baker’s outlet;

1.2. “User Account”- A set of information and entitlements regarding the Participant and their Brownie Points, maintained and can be checked at programme’s microsite;

1.3. “the Programme”- the ‘Nik Baker’s Club Rewards Programme’;

1.4. “Brownie Point”- the name of points that a Member will earn on purchases as stipulated in the terms & conditions of the programme;

1.5. “Regulations”- these terms & conditions;

1.6. “Programme Microsite”- the official programme microsite containing information about the Programme, benefits and special promotional campaigns, and enabling logging in to the User Account;

1.7. “Participant”- each user who has correctly registered in the Programme using the Registration Form and who is voluntarily participating in the Programme on the terms provided for in these Regulations;

1.8. “Member”- Customer subscribing to the Nik Baker’s Club Rewards Programme by creating a Account, validating its identifiers and having accepted the terms and conditions of use of the said Programme;

Eligibility Criteria

Participation in the Programme is open to all customers who is of 18 years of age or above and has the capacity to enter into a contract makes specified purchases or completes transactions as per the then prevailing terms of the Company, can become a member upon voluntarily providing his/her mobile number and other required details at the time of purchase at all exclusive NIK BAKER’S Stores.

We reserve the right that, if your age is below 18 years, you may have the right to use or make a purchase at our outlet or website under the direct supervision of your parents/guardians who also agree to be bound by our terms and conditions. Moreover, you are even prohibited to buy any product that is meant specifically for adult consumption, even at our outlet or while accessing our website under the supervision of your parents/guardians.

Membership Enrollment

To enroll in the Programme, customers must provide the necessary information (such as name, email address, and phone number) at Nik Baker’s exclusive store during the billing to earn the Brownie points. The Mobile number of the member (customer) will become primary identification for earning Brownie points upon purchase.

Nik Baker’s Club Rewards Programme membership is voluntary, valid for lifetime, and non-transferable. The Customer’s Mobile Number would be their unique identification number for the membership therefore member shall ensure to provide complete & correct mobile number as the registration for membership shall be done upon successful OTP verification at the given mobile number of the Customer. The enrollment shall be done upon successful verification of all the required information of the Customer by the Company.

All account details, special offers, updates and any other information and promotional communications would be sent through various modes of communication, including SMS, email tele-communication, WhatsApp and other modes of communication as applicable.

The Company’s decision concerning the member registration shall be final and binding. The Company reserves the right to refuse the membership to any customer without assigning any reasons thereof. Enrollment for membership is free of charge and non-transferable.

How does the Customer Accolade Programme works?

  • Earn brownie points on every purchase (Conversion= One [1] brownie point on every Rs. 100/- spent). One [1] Brownie Point= Re. 1/-.
  • Redeem accumulated Brownie Points on your next purchase with no minimum order value.
  • A customer can earn new Brownie Points on the bill value of the next order placed at Nik Baker’s exclusive store.

The number of Brownie points earned by a member is based on the tier category into which he/she falls. A customer will be classified as a Silver, Gold and Platinum member based on the total spends.

PLATINUM 50001 and above 3 (i) 20% discount on Club Member’s Birthday Cake upto 5 K.G. Weight only.
(ii) 20% discount on Club Member’s Anniversary Cake upto 5 K.G. Weight only.

Brownie points are awarded based on the amount spent. Brownie points will be credited to the Customer’s account upon completion of each transaction.

Brownie points will be earned only on Non-discounted items/Non discounted bill on Net Value excluding taxes, statutory levies, delivery or packaging charges etc.

The Brownie points, benefits & privileges are non-transferable & cannot be exchanged for cash and it may only be used by the member only.

If during the period of 12 months after the enrolment or after last upgrade, a member does not make requisite spends (Invoice amount less taxes, statutory levies, delivery or packaging charges etc.) required for him/her to maintain the existing Tier category, the member will be moved to the respective tier on the basis of his/her total spends in the last 12 months.

Company’s computation of Brownie points shall be final and binding. The member shall not raise any dispute or question in respect of the same.

Redeeming Brownie Points

Brownie Points can be redeemed in the form of purchase of goods with no minimum value from the Nik Baker’s exclusive Stores only on all non-discounted Invoices.

Customers can’t redeem from Brownie point balance for advance order’s advance payment but can pay the remaining balance while paying the total amount. Redemption options subject to change at the sole discretion of the Company.

Brownie Points cannot be redeemed for cash.

Exclusions

Certain purchases or transactions may be excluded from earning Brownie points at the discretion of the Company. The exclusions will be communicated to the customers in advance at the time of purchase.

Expiration, Forfeiture and Reversal

Brownie Points expire in 12 months from the date of credit of points. If Brownie Points not redeemed within 12 months from the date of credit of points, the Brownie points will automatically lapse and will not be re-credited in any condition.

Unused Brownie Points will be forfeited if the account remains inactive for a period of 12 months from the date of credit of points.

In case of any refund as per the Policy, the Company shall reverse/debit the earlier Brownie points credited, if any, in respect of the value of such refund.

In case of any cancellation of bill due to any software error/ /unsuccessful/unapproved transaction, the brownie points earned will stand cancelled.

Validity of the Brownie Points cannot be extended, OR new brownie Points cannot be provided against the expired/unused brownie points.

Account Management

Customers are responsible for maintaining their Nik Baker’s Club Rewards Programme membership account information and ensuring accuracy. Any discrepancies or issues with Brownie points earned or redeemed should be reported to the Company for resolution.

The members are requested to update any change in their registered mobile number, address and other profile information to us by sending an email at customercare@nikbakers.com or call at Company’s Toll Free Number 1800-137-3232. The members have to share their valid Govt. ID/Address Proof and any other document, if required, to update their account details.

The Company will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), Company will have all the authority to call such Participants by virtue of them having voluntarily participated in the Nik Baker’s Club Rewards Programme.

The Company accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected information, entries, claims or correspondence whether due to error, omission, alteration, tempering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, Software/hardware failure or otherwise. Company shall not be liable for any consequences of user error including (without limitation) costs incurred.

If a Participant is dissatisfied with the Nik Baker’s Club Rewards Programme Membership or its rules and/or any content or any requirements of the Nik Baker’s Club Rewards Programme, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Nik Baker’s Club Rewards Programme membership.

Company is not responsible for lost or stolen Brownie Points or accounts.

Customer Data

Company collects personal information from customers for the purpose of administering the Programme.

The Company will endeavour to keep member information confidential; however, the Company is entitled to share any such information.

Modification or Termination

Company reserves the right to terminate, modify, or suspend the Rewards programme at any time without prior notice.

Company may change these Terms & Conditions or add new Terms and Conditions at any time in our sole discretion. If so, we will publish an updated version on our website at http://www.nikbakers.com.

Company reserves the right to terminate a customer's participation in the Programme if we believe you have engaged in fraudulent or unlawful activity, or have failed to comply with these Terms & Conditions.

The Company may terminate the Rewards program at its sole discretion at any time without any reason whatsoever by notifying the same on its website. If the Rewards programme is terminated, all unredeemed Brownie Points will be forfeited without any obligation or liability, and no Award claims will be honored after the termination of Rewards programme.

Waiver

Every effort has been made to ensure that the information herein is correct. The Company is not responsible for any errors or omissions in printed copies of these Terms and Conditions nor those published from time to time on its website.

Any waiver by the Company of the strict observance, performance or compliance by a Member with any of the Terms and Conditions contained herein, either expressly granted or by course of conduct, shall be effective only in the specific instance and shall not be deemed to be a waiver of any rights or remedies of the Company as a result of any other failure to observe, perform or comply with the Terms and Conditions. No delay or omission by the Company in exercising any right or remedy hereunder shall operate as waiver thereof or of any other right or remedy.

In the event that any provision in these Terms and Conditions is determined to be invalid, illegal, or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions of these Terms and Conditions.

Limitation of Liability

Company is not liable for any indirect, incidental, or consequential damages arising from or in connection with the Programme.

The liability of the Company shall be limited to the extent of the then current value of outstanding Brownie points standing to the credit of the member as per the records maintained by the Company.

Indemnity

The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Nik Baker’s Club Rewards Programme by conducting an illegal act.

The Participant also undertakes to indemnify the Company and their respective officers, Directors, employees and agents on happening of such event (including without limitation of cost of attorney, legal charges etc.) on fully indemnity basis for any loss/damage suffered by the Company and their respective officers, Directors, employees and agents on account of such act on the part of the Participant.

In consideration of the Company, allowing the Participant/s to take part in the Nik Baker’s Club Rewards Programme membership, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (Present or Future) each of them has or may have against the Company, its respective agents, directors, officers, business associates, group Companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the or related to the Company’s Nik Baker’s Club Rewards Programme membership.

Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India and subject to Mohali Jurisdiction.

Force Majeure

Company’s obligation under the Nik Baker’s Club Rewards Programme is subject to force majeure conditions. In the event a force majeure situation occurs, Company shall not be responsible for any damage or loss which Company’s Members / applicants may suffer by reason of such a failure or delay of performance, and such failure or delay shall not be a breach on part of the Company.
